Public Offer for the Provision of BrainOS Services

Service (BrainOS) — software provided in the form of a Telegram bot that performs the functions of an intelligent assistant.

User — an individual using the Service via Telegram.

Offeror — Sayfullaev Djamshid

Subscription (Premium) — paid access to extended Service features for a specified period.

Telegram Stars — Telegram’s internal currency used to pay for digital services.

Plan — a set of features and limits available to the User (Basic, Premium, or Teams).

2.1. The Offeror provides the User with access to the BrainOS Service features in accordance with the selected plan.

2.2. The Service is provided in three options:

• Basic plan — free, with a limited set of features
• Premium plan — paid, with extended features and limits
• Teams plan — for teams of up to 3 people: everything included in Premium, plus the ability to share information within the team

2.3. Acceptance of this offer is deemed to occur upon:

• Starting to use the Service (the /start command in the bot)
• Payment for a Premium or Teams subscription

3.1. Basic plan (free)

• Basic intelligent assistant commands
• Limited number of requests per month — 100
• Basic support

3.2. Premium plan

• Unlimited number of requests
• All available integrations (Notion, Gmail, Calendar, etc.)
• Advanced automation features

3.3. Teams plan

For teams of up to 3 people.

• Everything included in the Premium plan
• Ability to share information within the team

4.1. The Basic plan is provided free of charge.

4.2. Premium subscription pricing:

• Monthly subscription: 250 Telegram Stars
• Annual subscription: 2700 Telegram Stars (10% discount)

4.3. Teams subscription pricing:

• Per month: 500 Telegram Stars (up to 3 team members)
• Additional user beyond the included 3: 99 Telegram Stars

4.4. Payment is made via the Telegram Stars system directly in the bot.

4.5. The subscription is activated automatically after successful payment.

4.6. The subscription is automatically renewed for the same period unless canceled by the User before the end of the current period.

4.7. Prices may be changed by the Offeror with at least 7 days’ prior notice to Users. Price changes do not apply to already paid periods.

5.1. The User may cancel the automatic renewal of the subscription at any time via the bot (the /premium or /settings command).

5.2. Upon subscription cancellation:

• Access to Premium features remains until the end of the paid period
• Automatic renewal is stopped
• Unused days are not refunded

5.3. After the paid period ends, the account is automatically switched to the Basic plan. If there is data in the database associated with paid features, such data shall be destroyed within 30 days from the end of the paid period.

6.1. Refund conditions for the Premium subscription are under development and will be published in a separate version after legal review.

Until the final refund policy is approved, refunds are made at the discretion of the Offeror.

7.1. The Offeror undertakes to:

• Ensure the operability of the Service
• Process personal data in accordance with the Privacy Policy
• Notify Users of significant changes to the terms of the offer

7.2. The Offeror has the right to:

• Suspend or terminate the provision of the Service for technical maintenance
• Change the Service functionality with notice to Users
• Restrict access in case of violation of the terms of use

7.3. The User undertakes to:

• Use the Service in accordance with its intended purpose
• Not use the Service for unlawful activities
• Ensure the confidentiality of their Telegram account

7.4. The User has the right to:

• Use the Service features within the selected plan
• Delete their data from the Service at any time
• Cancel the subscription without providing reasons

8.1. The Service is provided on an “as is” basis and is under development. The Service functionality may change, be supplemented, or be temporarily unavailable.

8.2. The Offeror shall not be liable for:

• technical failures and limitations in the operation of Telegram and third-party services integrated with the Service (including, but not limited to, Notion, Gmail, and other services);
• loss, damage, or distortion of data resulting from actions of third parties, infrastructure failures, or software errors;
• any decisions, actions, or inaction of the User based on recommendations, hints, or results generated by the AI assistant;
• interruptions in the Service caused by maintenance, updates, or error fixes.

8.3. The maximum liability of the Offeror for any User claims is limited to the amount actually paid by the User for the last paid subscription period.

8.4. The Offeror does not guarantee uninterrupted or continuous availability of the Service, but makes reasonable efforts to ensure its stable operation.

9.1. The Offeror has the right to amend the terms of this offer unilaterally.

9.2. Users are notified of changes via the bot at least 7 days before the changes take effect.

9.3. Continued use of the Service after the changes take effect constitutes acceptance of the new terms.

10.1. The User may stop using the Service at any time.

10.2. To completely delete data, the User may use the /delete_account command in the bot.

10.3. The Offeror has the right to terminate the agreement unilaterally in the following cases:

• Violation of the terms of use by the User
• Use of the Service for unlawful purposes
• Termination of the Service activity (with 30 days’ prior notice)

12.1. This offer and the relations between the Offeror and the User are governed by the laws of the Republic of Uzbekistan.

12.2. All disputes shall be resolved through negotiations. If no agreement is reached, disputes shall be referred to the court at the location of the Offeror.

13.1. This offer constitutes a public agreement.

13.2. The invalidity of individual provisions does not affect the validity of the offer as a whole.
